WHAT IS AN HOA?

HOA stands for Homeowner’s Association.

WHY DO WE HAVE A HOMEOWNERS ASSOCIATION (HOA)?

Walton, the developer of Woodhaven, felt it was desirable to have a homeowner association to attend to certain things that the City will not cover. The intent is to make sure that the neighborhood retains its value by ensuring that common areas are maintained.

WHERE DOES THE REQUIREMENT FOR THE HOA COME FROM?

Many communities have determined that they should be managing the maintenance of common areas within their community that are outside of the City’s responsibility. Setting up not-for profit Associations are a common approach to taking on that responsibility.

Responsibility is supported by the HOA encumbrance, a legal document that was filed at the Land Titles Office and shown on the title to your property. You should have received a copy of it with your real estate purchase documents. 

WHAT DOES THE HOMEOWNER ASSOCIATION DO?

The City of Edmonton is responsible for providing basic services to Woodhaven-Edgemont, as it does for other neighborhoods in the city.  However, the HOA may provide services the City doesn’t provide; examples might include enhanced landscaping, re-establishment and maintenance of an entry feature, additional lights, benches, flower beds or other things that would enhance the appearance of the neighborhood and maintain the reputation of Woodhaven-Edgemont as a quality location.

HOW DO WE FIND OUT MORE ABOUT THE HOA AND OTHER NEIGHBOURHOOD INFORMATION?

The Woodhaven-Edgemont website is intended to be the main method of communicating with the membership. The website includes the legal documents relating to the HOA, and provides information, updates and notices about the community and special events.

There is also a Facebook Group page in use in the community: Woodhaven Peeps Pups and Munchkins.  If you are a resident, you can ask for access to this group site.  If you are not on Facebook the website will be a useful source of information.

In addition, the HOA board will occasionally send notices to you by email. We ask that you keep us updated (through the HOA email address: board@woodhaven-edgemont.ca) regarding changes to your email contact information.

WHY AREN'T THE ANNUAL GENERAL MEETING PACKAGES SENT BY E-MAIL?

Due to the nature of email there is no way to guarantee that emails are delivered to their intended recipients. There may also be some sensitivity to some documents, such that they should be sent by post.

WHO IS RESPONSIBLE FOR MAINTAINING LANDSCAPING ADJOINING MY PROPERTY?

Responsibility for the landscaping adjoining individual properties is in part determined by City of Edmonton Bylaws:

  • Boulevards: Homeowners are responsible for maintaining the lawns up to the curb (front and side yards). Trees on the boulevard are the City’s responsibility.
  • Pond and surrounding land: The City of Edmonton has responsibility for the pond, and surrounding landscaping and walkways.
  • Pathways: The City of Edmonton has responsibility for maintaining the paths or walkways that follow the ravine and conservation areas, as well as the landscaping for one meter on each side. Lawns between the pathways and the homes are the responsibility of the homeowners other than the one meter abutment. Pathways that lead to the ravine path and or the pond areas are also maintained by the City, but the lawns adjoining the individual properties are the responsibility of the homeowner.
  • Fences: Fences that surround an individual property are the responsibility of the homeowner.
AM I RESPONSIBLE FOR WORK THAT I HAVE CONTRACTED OUT?

If you contract with or hire someone to do some work on your property, please ensure they are aware that any damages done to the community property or amenities must be repaired or returned to the original state they were in before the work was started. This includes damage to and clean-up of landscaping (trees, shrubs, flower beds, lawns, etc.), fences, and other. As the property owner, you will be liable for any damages that are not repaired to the satisfaction of the City of Edmonton.

WHAT IS THE HOA RESPONSIBLE FOR?

The HOA is responsible for working with the City and the community members,  and coordinating landscaping enhancements. To that end, the HOA Board has set up a Landscape Committee to contract out maintenance of the common areas (trails, shrub beds), as well as a Beautification Committee to develop and plan for landscaping enhancements and further beautification of the community.

HOW MUCH IS THE ANNUAL FEE?

We held our 2023 Annual General Meeting on April 12, 2023, and a Special Resolution was passed to increase the annual fees for 2024 to $84.88. The Encumbrance amount for each property is $75.00 per year and is subject to an annual adjustment by percentage increase, if any, of the Consumer Price Index (CPI).

The HOA has de-registered from collecting GST.

DO ALL RESIDENTS OF WOODHAVEN-EDGEMONT PAY THE ANNUAL HOA FEE?

Yes, the annual HOA fees are mandatory. That includes the Cove Property condominiums as well as the Walton Phase 1 Development homes. All property owners in Woodhaven-Edgemont have an encumbrance to the Woodhaven-Edgemont HOA on their Certificate of Title.

CAN I SETUP AN AUTOMATIC PAYMENT FOR MY ANNUAL FEE?

We are not able to setup automatic payments.

I WAS NEVER TOLD ABOUT THE HOA OR THE FEES WHEN I BOUGHT MY HOUSE. WHAT SHOULD I DO?

It is the responsibility of your lawyer when you purchase a home in Woodhaven-Edgemont to inform you of the HOA and the associated fee. It is also the responsibility of your lawyer to advise you of any outstanding HOA fees due on the property.

WHO DECIDES WHERE THE HOA FEES ARE SPENT?

The Homeowners nominate the Board of Directors at the annual AGM.  The Board meets as required to discuss financial, maintenance and improvement, and other matters of the neighborhood.

WHAT IS THE HOA FEE FOR?

The HOA fee will go towards providing maintenance and beautification of the neighborhood.  The HOA fees will not allow us to pay for large scale projects, but with good management, the HOA can ensure that Woodhaven continues to meet an acceptable standard.

WHAT IF I DON'T PAY THE HOA FEE?

Payment of the HOA fee is a requirement for all owners of property in Woodhaven-Edgemont.  If the fee is not paid, it accrues interest at the rate of 18% per year, calculated monthly.  If a Homeowner is in arrears, the HOA can register a lien on the property, charging the legal costs to the owner. Outstanding fees must be paid before the property can be sold.

A Restrictive Covenant is a binding and enforceable restriction on the use or uses permitted on the specified property on which it is registered. To determine what restrictive covenants are applicable to a specific property, a search may be made of the applicable title at any Registry Office in Alberta.
